Welcome to Trupin. These Terms of Service ("Terms") govern your access to and use of the Trupin mobile application (www.app.trupin.co.uk), website (www.trupin.co.uk), and related services (collectively, the "Services"). By using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

   By accessing or using Trupin, you represent that you have read, understood, and agree to be legally bound by these Terms and any additional guidelines or rules incorporated by reference. If you do not agree to these Terms, you must refrain from using our Services.

2. Eligibility

   • Age Requirement: You must be at least 13 years old to use Trupin. If you are under 18, you must have the consent of a parent or legal guardian.
   • Legal Capacity: You represent and warrant that you have the legal capacity to enter into these Terms.

3. User Accounts

   • Registration: To contribute content on our map, you are required to register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
   • Security: You are responsible for safeguarding your account credentials and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized use of your account.
   • Account Termination: We reserve the right to suspend or terminate your account if you breach these Terms or engage in any conduct that we determine, in our sole discretion, is harmful to other users or the integrity of our Services.

4. User Content

   Trupin enables you to add location-based information, photographs, and tags ("User Content") to our map.

   • Ownership and License: While you retain ownership of your User Content, by posting content on Trupin you grant us a non-exclusive, worldwide, royalty-free, perpetual, and transferable license to use, reproduce, modify, distribute, display, and perform the User Content in connection with providing our Services.
   • Your Representations: You represent and warrant that you have all necessary rights, licenses, and permissions to post your User Content and that it does not violate any third-party rights.
   • Responsibility: You are solely responsible for the User Content you upload. We assume no responsibility for User Content and do not guarantee its accuracy, truthfulness, or reliability.

5. Prohibited Conduct and Content

   You agree not to use Trupin in any way that violates these Terms or applicable law. In particular, you agree not to:

   • Post False or Misleading Information: Do not publish content that is intentionally false, misleading, or deceptive.
   • Distribute Illegal Content: Do not post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
   • Share Offensive Material: Do not upload content that is obscene, offensive, or intended to shock or disgust. We reserve the right to remove such content and to suspend or terminate the accounts of repeat offenders.
   • Infringe on Intellectual Property Rights: Do not post content that you do not own or have permission to share, including copyrighted material, trademarks, or other proprietary information.
   • Engage in Data Scraping or Automated Access: Do not use bots, spiders, scrapers, or other automated tools to access, monitor, or copy any portion of our Services without our prior written consent.
   • Impersonate or Misrepresent: Do not impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity.

6. Intellectual Property Rights

   Our Rights: All trademarks, service marks, logos, and trade names used on Trupin are owned by or licensed to us. Nothing in these Terms grants you any right, title, or interest in or to our intellectual property.

   User-Submitted Content: While you retain ownership of your User Content, you grant us a license to use your content as described in Section 4 above.

7. Third-Party Links and Content

   Our Services may include links to third-party websites or resources. We do not control and are not responsible for the content, privacy policies, or practices of any third parties. Your use of any third-party sites is at your own risk and subject to the terms of use of those sites.

8. Disclaimer of Warranties

   Your use of Trupin is at your sole risk. The Services are provided "as is" and "as available" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

9. Limitation of Liability

   To the fullest extent permitted by law, in no event will Trupin, its affiliates, or their respective officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Services, even if advised of the possibility of such damages.

10. Indemnification

    You agree to indemnify, defend, and hold harmless Trupin and its affiliates, officers, directors, employees, and agents from and against any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services or your breach of these Terms.

11. Governing Law and Jurisdiction

    These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in England and Wales.

12. Changes to the Terms

    We reserve the right to modify, update, or replace these Terms at any time. We will notify you of any significant changes by posting the updated Terms on our website or within the app. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
